Acceptable use of Services

• This Acceptable Use Policy (“Policy”) describes the prohibited uses of any services provided to you by Moddey Dhoo PLC (“Services”).
• By using or accessing the Services, you are agreeing to this Policy.
• You are solely responsible for:
• the content, materials, and data that you create outside the Services and upload to and process on the Services;
• the content, materials, and data that you create, collect, or process through your use of the Services;
• And applications and other software that you install on the Services (together “Client Content”).
• This Policy applies to all uses of the Services including use resulting from or involving Client Content.
• You will comply with all applicable laws and regulations when using the Services and will not allow any illegal or improper use of the Services.

Changes to the Policy

• Moddey Dhoo PLC reserves the right to amend or modify this Policy at any time.
• You are expected to check this page from time to time to take notice of any changes Moddey Dhoo PLC makes, as they are legally binding on you.
• Moddey Dhoo PLC will notify you of any significant amendments to this Policy.
• If you continue to use the Services following a change to this Policy you will be deemed to have accepted the change.

Policy applies to all Users

• This Policy applies to the use of the Services by all your users, your customers, third-party service providers, and other end-users (“Users”). You are responsible for the acts and omissions of all Users.
• You agree not to encourage, promote, facilitate, or instruct others to undertake, or attempt to undertake, prohibited use of the Services as defined by this policy.
• You must ensure that any end-user submitted content (such as forum posts or chat room entries) meets the standards defined within this Policy.

Security

• Your use of the Services must be configured to prevent unauthorized use or access.
• You must not disable, interfere with, abuse, disrupt, circumvent, or otherwise violate the security of Moddey Dhoo PLC’s Services or another’s use of the Services.
• You may not use the Services or allow the Services to be used to:
  • gain unauthorized access to computer systems or engage in security attacks of any kind including:
    1. against trust (such as email spoofing, password cracking, IP spoofing, and DNS poisoning);
    2. against confidentiality and integrity (by using malware such as computer viruses, worms, trojan horses, rootkits, keyloggers, spyware, or other malicious programs and code);
    3. or against availability (such as denial of service and email bombs);
  • corrupt, modify, or intercept electronic communications intended for any other person or entity;
  • corrupt, modify, or destroy website content or other information;
  • or interfere with or disrupt the operation of Moddey Dhoo PLC’s services or another’s use of the Services.
• You must comply with any limitations Moddey Dhoo PLC places on your use of the Services.

Abuse and Illegal Behaviour

You may not use the Services to:

• breach any applicable laws, regulations, or government requirements of any jurisdiction;
• conduct or engage in any fraudulent or illegal business or activity, for example:
  1. export control violations;
  2. fraud;
  3. forgery;
  4. pyramid or other prohibited business schemes;
  5. theft, misappropriation, or unauthorized transmission or storage of funds, credit card information, personal information, or online services;
  6. solicitation or sale of any harmful/illegal products or services.
• infringe any third-party intellectual property right, for example:
  1. copyrights;
  2. patents;
  3. trademarks;
  4. trade secrets or know-how.
• participate in any file-sharing/peer-to-peer activities that infringe any third-party intellectual property right;
• provide information, instructions, links, etc containing malicious code;
• collect, copy, or process information in a way that breaches data protection laws or leads to a wrongful breach of privacy, for example;
  1. misrepresentation of member’s identity, or impersonation;
  2. collection of personal information for illegal purposes;
  3. collection of personal information without users' permission.
• create, distribute, process, or view any:
  1. defamatory;
  2. obscene, indecent, or illegal material, including child pornography;
  3. racist, sexist, or otherwise discriminatory;
  4. misleading, deceptive, or fraudulent;
  5. hate speech or hate propaganda;
  6. or otherwise objectionable or offensive material;
• be abusive, threatening, invade another's privacy, or cause annoyance, inconvenience, or needless anxiety.

Email and Spam

• You may not use the Services to distribute email, instant messages, text messages, or other communications in an unacceptable or illegal manner. For example, you may not:
1. create or send hoax emails or chain emails;
2. send unsolicited commercial email or bulk email (“spam” or “spamming”);
3. harvest email addresses;
4. use open proxies or relays to allow spamming;
5. impersonate someone else (“spoofing”) or falsify message header information.
• All commercial email promoting goods or services you send using the Services must comply with all applicable laws, rules, regulations, industry codes, and similar guidelines.

Data Protection

• As Moddey Dhoo PLC’s customer, you use the Services to host, transmit, or process data on Moddey Dhoo PLC’s hosting platforms, which may include personal data of your customers.
• For the avoidance of doubt, under these circumstances, you stipulate the process for collecting your customer’s personal data. Most importantly, Moddey Dhoo PLC do not have knowledge of or view, share, collect, or process this personal data.
• Moddey Dhoo PLC’s relationship is with you directly, there is no agreement in place between Moddey Dhoo PLC and your customers, and you are responsible for any applicable regulatory or legal requirements in respect of your customers’ personal data.
• You are responsible for:
1. complying with any applicable data protection regulations with respect to your customers' personal data;
2. managing the security of your customers' personal data, including backup;
3. ensuring secure access to such data.

Suspension or Termination

• Moddey Dhoo PLC will determine, in its discretion, whether there has been a breach of this Policy through your use of the Services. While Moddey Dhoo PLC do not routinely monitor, or censor, the use of the Services, when a breach of this policy has occurred, Moddey Dhoo PLC may take such action, as it deems appropriate.
• If you breach this Policy or misuse the Services, or allow others to do so, Moddey Dhoo PLC may suspend or terminate your use of the Services.
• Failure to comply with this Policy constitutes a material breach of our Terms and Conditions upon which you are permitted to use the Services, and may result in Moddey Dhoo PLC taking all or any of the following actions:
1. immediate, temporary, or permanent withdrawal of your right to use the Services;
2. immediate, temporary, or permanent removal or archiving of any content that is abusive or illegal (as defined in section 5 of this Policy);
3. block access to any content that is abusive or illegal (as defined in section 5 of this Policy);
4. issue of a warning to you;
5. issue of legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
6. further legal action against you;
7. disclosure of such information to law enforcement authorities as Moddey Dhoo PLC reasonably feels is necessary or are legally required to do so.
• When appropriate, Moddey Dhoo PLC allow a defined period of notice during which violations may be addressed voluntarily. However, Moddey Dhoo PLC reserve the right to act without notice.
• Moddey Dhoo PLC does not accept liability for actions taken in response to breaches of this Policy. The responses described in this Policy are not limited, and Moddey Dhoo PLC may take any other action reasonably considered appropriate.
